Jack Thompson countersues Take Two as promised

Earlier this week, Gamesdog reported that Take Two Interactive launched a legal action against Jack Thompson, the anti violent game Florida lawyer, to stop him filing his own suits to prevent the publisher from releasing Grand Theft Auto IV and Manhunt 2.

Thompson said that he had “been praying that Take Two and its lawyers would do something so stupid” and promised he would “strike back” and today he filed his response to the Take Two suit.

Included in the package of litigation was a countersuit saying that Take Two had multiply violated the Racketeer Influenced and Corrupt Organizations Act (RICO), specifically a continued effort to violate his constitutional rights since July 2005.

Thompson’s defence in Take Two’s suit is that Take Two violated his First Amendment right "to petition the government for a redress of grievances".

Take Two’s suit is looking to have Thompson barred from filing suit to have its games (or any games) declared a public nuisance in Florida which would make selling them a crime.

The background of the repetitive legal action lies in Thompson’s dislike of Take Two’s games and he refers to GTA: Vice City as a "violence and sex simulation game" that perpetuates racial stereotypes.

He said of Take Two, "What else would one expect of Scottish sociopaths sipping their single malt Glenlivet in between brainstorming software programming sessions?"
