Woman sues Vivendi and Sony over Spyro epileptic fit

New Yorker claims Spyro: Enter the Dragonfly caused her child’s seizures

Having suffered bad reviews on release, Spyro: Enter the Dragonfly has again been criticised, but this time is the form of a lawsuit against Vivendi Games, Sierra Entertainment, Sony Computer Entertainment America, and Hiawatha Video, a rental store.

The woman claims that all involved were, "negligent, careless, and reckless with regard to the design and manufacture" of Spyro. She goes on to claim that the game was dangerous when used in the intended manner, and that there was no sufficient warning for gamers.

She alleges that the child has suffered severe and permanent injuries, which, due to their disabling nature, will affect him "in all activities of daily living" and necessitate lifelong medical expenses, for which the woman is after damages "for such fair and reasonable amount as may be awarded by a jury of his peers".

The defendants are sure to fight the suit pointing out that the title did come with a warning on the inside front cover of the instruction manual saying that "a very small percentage of individuals may experience epileptic seizures when exposed to certain light patterns or flashing lights".

Back in August of 2003, Nintendo was sued by a woman in Louisiana whose son died as the result of a seizure he had while playing the Nintendo 64. Nintendo won after the woman didn’t respond to the nintendo’s motion for summary judgement.
